Privacy Policy

1. Who we are and where this Policy applies

This Privacy Policy explains how Maxima Apps (“Maxima Apps”, “we”, “us”) collects, uses, shares and protects information when you use the MenuSmart iOS application and any related websites, features and services (together, the “App” or “Services”).

MenuSmart helps you find restaurants, explore menus, and choose meals that fit your goals. Its features include restaurant search and menu discovery, personalized meal recommendations, goal-based meal collections, a personalized Menu Item Fit Score, food preference and dietary restriction settings, calorie and macro information, an AI Menu Chat Assistant, and Healthify a Meal, which suggests changes to make a menu item healthier.

By using MenuSmart you acknowledge this Policy. If you do not agree with it, please do not use the App. This Policy should be read together with the MenuSmart Terms of Use.

2. Information you give us

We collect only what we need to run the features you choose to use.

  • Account information. If you create an account, we collect your name, email address and login credentials. If you sign in with Apple, Google or another third-party provider, we receive the profile information you allow that provider to share, typically your name and email address. If you use Sign in with Apple and choose “Hide My Email”, we receive only a relay address.

  • Profile photo. If you add a profile photo, we store the image you take or select so it can be shown on your profile.

  • Food preferences, dietary restrictions and goals. You can tell us about cuisines and ingredients you like or dislike, dietary patterns (for example vegetarian, vegan, keto, halal), allergies or intolerances, and goals such as weight loss, muscle gain or a calorie or macro target. You may also choose to provide details such as age, sex, height, weight or activity level so we can personalize targets. This information can reveal details about your health, and some laws treat it as sensitive personal data. Providing it is optional, and we use it only to personalize your recommendations, collections and Fit Scores.

  • AI Menu Chat content. When you use the AI Menu Chat Assistant, we collect the messages you type or speak, any photos you attach, and the responses generated for you.

  • Photos of food and menus. When you photograph or upload a menu or a dish, we process the image to read menu text, identify food items and estimate nutrition information.

  • Voice input. When you use voice search or voice input, your speech is converted to text so the App can act on it. See Section 3 for how audio is handled.

  • Saved items and activity. Restaurants and dishes you save, meals you log or rate, collections you follow, and searches you run.

  • Support and feedback. Information you include when you contact us, report a problem or answer a survey.

3. Device permissions

MenuSmart asks for device permissions only when you use a feature that needs them. iOS shows a system prompt before any access, and you can change each permission at any time in Settings > MenuSmart. Declining a permission only disables the feature that depends on it; the rest of the App keeps working.

MenuSmart may request the following permissions: Location, Camera, Photos, Microphone, Speech Recognition, and App Tracking Transparency (ATT). Each one is optional. If you decline Location, you can still search by city or address. On iOS you can also choose to share only selected photos rather than your whole library. How we handle ATT is explained in Section 7.

Location. We request location only while you are using the App (“While Using the App”). We do not collect location in the background. You may grant precise or approximate location; with approximate location, nearby results may be less accurate. We use location to find restaurants and do not build a history of your movements.

Camera and Photos. We access only the images you capture or select. We do not scan or upload your photo library. Images used for menu or food scanning and AI Chat are processed to provide the feature you requested (see Section 5). Your profile photo is stored with your account until you change or delete it.

Microphone and Speech Recognition. The microphone is active only while you are using a voice feature, and iOS shows an indicator when it is in use. Speech recognition may be performed on your device or by Apple’s speech recognition service, depending on your device and language settings; when Apple’s service is used, Apple processes the audio under its own privacy policy. We receive the resulting text, not a recording, and we do not store voice recordings.

4. Information collected automatically and from others

Usage information. We collect how you use the App, such as screens viewed, features used, searches, restaurants and dishes opened, recommendations shown and selected, session times and ads you interact with.

Device information. Device model, iOS version, app version, language, time zone, IP address, crash logs and performance data, and identifiers such as the IDFV (identifier for vendor). We access the IDFA only if you allow tracking through the ATT prompt.

Analytics and crash reporting. We use third-party tools such as Google Firebase to understand app performance and usage. These providers process device and usage data on our behalf under their own privacy policies (for Google, see policies.google.com/privacy).

Restaurant and menu data. Restaurant listings, menus, prices and nutrition information come from third-party data providers, restaurants and public sources. This is information about businesses, not about you.

Sign-in providers. If you sign in with a third-party account, we receive the information described in Section 2.

Advertising and attribution partners. Ad networks and attribution partners may share information with us, such as whether an ad led you to install the App or how a campaign performed.

Purchases. If you buy a subscription or in-app purchase, payment is handled by Apple. Apple does not share your name, email or payment details with us. We receive transaction information such as the product purchased, purchase date, renewal status and an anonymous transaction identifier, which we use to unlock premium features. We may use a subscription management provider to process this transaction information.

5. AI features

Several MenuSmart features use artificial intelligence: the AI Menu Chat Assistant, menu and food photo analysis, personalized recommendations, the Menu Item Fit Score, and Healthify a Meal.

What is processed. To answer you, these features use the content you submit (messages, voice-to-text, photos) together with relevant context such as the menu you are viewing, your saved preferences, dietary restrictions and goals.

Third-party AI providers. We use third-party AI model providers to generate responses and analyze images. We send them only the information needed for the request. We do not send your name, email address or account credentials. Our agreements with these providers require them to process the data only to provide the service to us and not to use it to train their general-purpose models.

How we use AI content. We store your chat history so you can see past conversations. We may review de-identified or aggregated chat and feature data to improve accuracy and safety. You can delete your chat history in the App or by deleting your account.

Automated personalization. Fit Scores, recommendations and Healthify suggestions are generated automatically from your inputs. They are suggestions only and do not produce legal or similarly significant effects on you. You can change or remove your preferences at any time, which changes the results.

Accuracy. AI output, nutrition values and allergen information may be incomplete or wrong. Always confirm ingredients and allergens with the restaurant. See the Terms of Use for more.

6. How we use information and our legal bases

We use your information for the purposes below. Where data protection laws such as the GDPR apply, each purpose relies on the legal basis shown.

  • To provide the App: showing nearby restaurants and menus, running search and voice input, operating AI Chat, and managing your account and subscription. Legal basis: performance of our contract with you.

  • To personalize your experience: recommendations, goal-based collections, Fit Scores and Healthify suggestions based on your preferences and goals. Legal basis: contract, and your explicit consent for health-related and dietary data.

  • To improve and develop the App: analytics, crash diagnosis, testing new features, and improving recommendation and AI accuracy. Legal basis: legitimate interests.

  • To communicate with you: account and security notices, service changes, and replies to support requests. Legal basis: contract and legitimate interests.

  • For marketing: newsletters and promotional messages about MenuSmart. Legal basis: consent, which you can withdraw at any time.

  • For advertising: showing ads in the App, with personalized ads and measurement only if you allow tracking. Legal basis: consent (ATT and, where required, local consent); legitimate interests for contextual ads.

  • For safety and legal compliance: preventing fraud and abuse, enforcing our Terms, and responding to lawful requests. Legal basis: legal obligation and legitimate interests.

We do not use your dietary restrictions, health-related goals or body measurements for advertising, and we do not share them with advertising partners.

7. Advertising, App Tracking Transparency and your choices

MenuSmart may show ads and may work with advertising and attribution partners that use software development kits (SDKs) in the App.

App Tracking Transparency (ATT). Before we or our partners access your device’s advertising identifier (IDFA) or track you across apps and websites owned by other companies, iOS will show you the ATT prompt. No tracking, as Apple defines it, happens unless you tap “Allow”.

  • If you allow tracking, we and our partners may use your IDFA and related device data to show you personalized ads and measure how well ads and campaigns perform.

  • If you deny tracking, we will not access your IDFA or track you. You may still see ads, but they will be contextual (for example, based on the screen you are viewing) rather than based on your activity across other apps.

You can change your choice at any time in Settings > Privacy & Security > Tracking. Choosing “Ask App not to Track” does not limit your use of MenuSmart.

Partners as independent controllers. Some advertising partners decide for themselves how to use data they collect through their SDKs. Their use is governed by their own privacy policies.

Removing ads. Where offered, a paid subscription removes in-app advertising.

8. Sharing, retention and security

We do not sell your personal information. We share it only as follows:

  • Service providers that help us run the App, such as cloud hosting, analytics, crash reporting, AI model providers, restaurant and menu data providers, subscription management and customer support. They may use the data only to provide services to us.

  • Advertising and attribution partners, as described in Section 7, and only device and usage data. Tracking data is shared only if you allow it through ATT.

  • Sign-in providers, to the extent needed to authenticate you.

  • Legal and safety reasons, when required by law or to protect the rights, safety or property of our users, Maxima Apps or others.

  • Business transfers, if Maxima Apps is involved in a merger, acquisition or sale of assets, subject to this Policy.

  • With your consent or at your direction, for example when you share a dish or restaurant from the App.

International transfers. Our providers may process data in countries other than yours, including India and the United States. Where required, we use safeguards such as standard contractual clauses.

Retention. We keep your information while your account is active or as needed to provide the App. When you delete your account, we delete or anonymize your personal information within 30 days, except where we must keep some of it to meet legal, tax or fraud-prevention obligations. Backups are overwritten on a rolling basis. Photos used only for scanning are processed for the request and not kept, unless you attach them to an AI Chat or set them as your profile photo.

Deleting your account. You can delete your account and associated data at any time from within the App (Profile > Settings > Delete Account) or by emailing us. Deleting the App from your phone does not delete your account. Active subscriptions must be cancelled separately in your Apple ID settings.

Security. We use reasonable technical and organizational measures, including encryption in transit, access controls and limited staff access. No method of transmission or storage is fully secure, so we cannot guarantee absolute security.

9. Children

MenuSmart is not directed to children under 13, and we do not knowingly collect personal information from them. Where local law sets a higher age of digital consent (for example 16 in parts of the EEA, or 18 under India’s Digital Personal Data Protection Act), users below that age need verifiable parental consent. If you believe a child has given us personal information, contact us and we will delete it.

10. Your rights

Depending on where you live, you may have the right to access, correct, delete or receive a portable copy of your personal information; to restrict or object to processing; and to withdraw consent at any time without affecting earlier processing. Many of these can be done directly in the App by editing your profile and preferences or deleting your account.

EEA, UK and Switzerland (GDPR). You have the rights above, plus the right not to be subject to solely automated decisions with legal or similarly significant effects, and the right to complain to your local data protection authority.

California (CCPA/CPRA). You have the right to know, delete and correct personal information, to opt out of the sale or sharing of personal information for cross-context behavioral advertising, and to limit the use of sensitive personal information. We do not sell personal information. You can opt out of sharing for advertising by denying or withdrawing ATT permission. We will not discriminate against you for exercising your rights. You may use an authorized agent.

India (DPDP Act, 2023). You have the right to access information about your personal data, to correct, complete, update and erase it, to nominate another person to exercise your rights, and to grievance redressal. You may contact our Grievance Officer at the address below.

Other regions. We honor other rights available under applicable law.

To exercise any right, email us. We may need to verify your identity, and we will respond within the time required by law.

11. App Store privacy disclosures

The data categories on MenuSmart’s App Store product page reflect what the App actually collects and are consistent with this Policy.

13. Changes to this Policy

We may update this Policy from time to time. We will change the “Last updated” date at the top of this Policy and, for material changes, notify you in the App or by email before they take effect.
