Terms of Use
1. Agreement
These Terms of Use (“Terms”) are a legal agreement between you and Maxima Apps (“Maxima Apps”, “we”, “us”) governing your use of the MenuSmart iOS application and related services (the “App”). By downloading, installing or using the App, you agree to these Terms and confirm that you own or control the device on which you use it. If you do not agree, do not use the App.
These Terms also apply to updates, supplements and features of the App unless they come with separate terms. Your use of the App is also subject to the MenuSmart Privacy Policy, which is incorporated into these Terms by reference, and to the rules of the Apple App Store.
Changes. We may update these Terms from time to time. For material changes, we will notify you by reasonable means, such as an in-app message or email, before they take effect. If you keep using the App after the changes take effect, you accept the updated Terms. If you do not agree, stop using the App and delete your account.
Consumer rights. Depending on where you live, you may have rights under consumer protection law that these Terms cannot limit. Nothing in these Terms affects those rights.
2. Eligibility and age
You must be at least 13 years old to use MenuSmart. If you are under 18 (or the age of majority where you live), you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. If you are a parent or guardian and believe a child under 13 is using the App, please contact us.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
4. Restrictions
You agree not to:
copy, rent, sell, lease, sublicense, distribute or otherwise transfer the App or any rights in it;
modify, reverse engineer, decompile or disassemble the App, except where the law expressly allows it;
scrape, crawl or harvest restaurant, menu, nutrition or other data from the App, or use bots or automated means to access it;
use the App or its data to build a competing product or dataset, or to train AI or machine-learning models;
attempt to bypass security, usage limits or subscription controls, or interfere with the App’s servers or networks;
use the AI features to generate unlawful, harmful, harassing or misleading content, or try to extract system prompts or make them behave in ways they are not meant to;
impersonate any person or misrepresent your affiliation with anyone; or
use the App in violation of any law.
Updates. We may add, change or remove features at any time. Some updates may be required to keep using the App. The App communicates with our servers and needs an internet connection for most features. You are responsible for your device, internet access and any carrier charges.
5. Health, nutrition, allergen and AI disclaimers
Please read this section carefully.
Not medical advice. MenuSmart provides general information to help you make food choices. It is not a medical device and does not provide medical, nutritional or dietetic advice, diagnosis or treatment. Recommendations, collections, Fit Scores and Healthify suggestions are not a substitute for advice from a doctor, registered dietitian or other qualified professional. Consult one before changing your diet, especially if you are pregnant, have a medical condition such as diabetes, kidney disease or an eating disorder, or take medication.
Nutrition information is an estimate. Calories, macros and other nutrition values may come from restaurants, third-party databases or AI estimates. Portion sizes, recipes, ingredients and preparation vary between locations and over time, so actual values may differ significantly.
Allergens and dietary restrictions. MenuSmart cannot guarantee that any menu item is free of an allergen or meets a dietary, religious or ethical requirement (such as gluten-free, vegan, halal or kosher), even if you have set that restriction in the App. Menu data may be incomplete or out of date, and cross-contamination can occur in restaurant kitchens. If you have a food allergy or intolerance, always confirm ingredients and preparation directly with restaurant staff before ordering. You are solely responsible for what you choose to eat.
Healthify a Meal. Healthify suggestions are ideas for modifying a dish. Restaurants may not be able or willing to make the changes, and the modified dish’s nutrition values are estimates.
AI-generated content. The AI Menu Chat Assistant and other AI features generate responses automatically. They can be inaccurate, incomplete or out of date, and may misread photos of menus or food. Do not rely on AI output as the sole basis for health, allergy or safety decisions. AI responses do not reflect the views of Maxima Apps.
Emergencies. If you experience an allergic reaction or other medical emergency, contact your local emergency services immediately.
6. Restaurant information and third-party services
Restaurant data. Restaurant listings, menus, prices, opening hours and nutrition data come from third-party providers, restaurants and public sources. We do not control restaurants and do not guarantee that this information is accurate, complete or current. Listing a restaurant is not an endorsement. Any order, booking or purchase you make with a restaurant is between you and that restaurant.
Third-party services. The App may link to or integrate third-party services, such as maps, sign-in providers, delivery or reservation services, and AI model providers. Their own terms and privacy policies apply, and we are not responsible for their content, services or practices.
7. Location and device permissions
Some features need device permissions, which you can grant or revoke at any time in your iOS Settings:
Location is used to show nearby restaurants and personalize results. Location-based results are approximate and should not be relied on for navigation or critical purposes.
Camera and Photos are used only for actions you start: scanning menus or food, attaching photos in AI Chat, and setting a profile photo.
Microphone and Speech Recognition are used only while you use voice search or voice input.
Declining a permission disables only the features that need it. See the Privacy Policy for details.
8. Accounts
Some features require an account. You agree to provide accurate information, keep your login credentials confidential, and tell us promptly about any unauthorized use. You are responsible for activity under your account. If you sign in through Apple, Google or another provider, that provider’s terms also apply. You can delete your account at any time in the App.
9. Your content
“Your Content” means anything you submit through the App, including photos, chat messages, voice input converted to text, reviews, ratings and profile information.
Ownership. You keep ownership of Your Content.
License to us. You grant Maxima Apps a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display Your Content only as needed to operate, provide and improve the App, as described in the Privacy Policy. This license ends when you delete Your Content or your account, except for copies we must keep by law or that exist in routine backups.
Your responsibility. You confirm you have the rights to Your Content and that it does not violate the law or anyone’s rights. Do not upload photos of other people without their permission.
Prohibited content. You may not submit content that is unlawful, harmful, hateful, harassing, obscene, infringing, or contains malware.
Moderation. We may remove content or restrict accounts that break these Terms, and we may disclose information when required by law.
Feedback. If you send us ideas or suggestions, we may use them without obligation to you.
10. Subscriptions and purchases
MenuSmart may offer premium features through auto-renewable subscriptions or one-time in-app purchases. The price, billing period and included features are shown in the App before you buy.
Billing. Payment is charged to your Apple ID account when you confirm the purchase. All purchases are processed by Apple under the Apple Media Services Terms.
Auto-renewal. Subscriptions renew automatically at the end of each period unless you turn off auto-renew at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours before the period ends.
Free trials. If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a trial is forfeited when you buy a subscription.
Managing and cancelling. You can manage or cancel subscriptions in Settings > \[your name\] > Subscriptions on your device. Deleting the App or your account does not cancel a subscription.
Refunds. Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases.
Price changes. We may change subscription prices. Apple will notify you in advance as required, and you can cancel before the new price applies.
Restore purchases. You can restore eligible purchases on another device signed in with the same Apple ID using “Restore Purchases” in the App.
11. Privacy and tracking consent
Our Privacy Policy explains how we collect and use information. Consent to tracking through your device’s advertising identifier (IDFA) is requested only through Apple’s App Tracking Transparency prompt. That consent is separate from your acceptance of these Terms. Allowing or denying tracking does not affect your right to use the App, and you can change your choice at any time in Settings > Privacy & Security > Tracking.
12. Intellectual property
The App, including its software, design, text, graphics, Fit Score methodology, collections and compiled data, is owned by Maxima Apps or its licensors and protected by intellectual property laws. Restaurant names and trademarks belong to their owners. These Terms do not give you any right to use our names, logos or trademarks.
Copyright complaints. If you believe content in the App infringes your copyright, email us with details of the work, the infringing content, and your contact information. We may terminate users who repeatedly infringe.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you break these Terms, if required by law, or if we stop offering the App. Where reasonable, we will give notice. Sections that by their nature should survive termination, including Sections 5, 9, 12 and 14 to 18, will survive.
14. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure, or that any restaurant, menu, nutrition, allergen or AI information is accurate. Some jurisdictions do not allow these exclusions, so some may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, Maxima Apps will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the App. This includes harm resulting from relying on nutrition, allergen, dietary or AI-generated information, or from food you buy or eat at a restaurant. Our total liability for any claim will not exceed the greater of the amount you paid us for the App in the 12 months before the claim or USD 50. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be limited by law.
16. Indemnification
You agree to indemnify and hold harmless Maxima Apps and its affiliates, officers and employees from third-party claims arising from your breach of these Terms, Your Content, or your misuse of the App.
17. Apple-specific terms
These Terms are between you and Maxima Apps only, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the App.
Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims.
Apple is not responsible for investigating, defending or settling any third-party claim that the App infringes intellectual property rights.
You confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing law and general terms
These Terms are governed by the laws of India, without regard to conflict-of-law rules, and the courts of Mumbai, Maharashtra have jurisdiction, unless the mandatory consumer laws of your country give you the right to bring claims in your local courts. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App. The App is subject to applicable export control laws.
