Terms of Use
Agreement
This End-User License Agreement (“EULA” or “Terms”) governs your use of the Translate AI application (the “App”) and is a legal agreement between you and Maxima Apps (“Maxima Apps”, “we”, “us” or “our”). By installing or otherwise using the App, you: (a) agree to be bound by the terms and conditions of this EULA; (b) represent and warrant that you own or control the Apple device on which the App will be installed; and (c) represent and warrant that you have the right, authority and capacity to enter into this EULA and to abide by all of its terms and conditions.
The terms and conditions of this EULA also apply to any updates, supplements and services for the App that are not provided under a separate license or agreement with us. If you do not agree to the terms and conditions of this EULA, do not install or use the App.
We may amend this EULA from time to time. If the changes are material and affect your rights or obligations, we will notify you by reasonable means, which may include an in-app message shown when you open the App. Your continued use of the App after the amended EULA takes effect signifies your acceptance of it. If you do not agree with any amendment, you must stop using the App and cancel any subscription.
Notice to consumers: depending on the laws of the jurisdiction where you live, you may have rights that cannot be waived by contract and that are in addition to this EULA, and certain provisions of this EULA may be unenforceable as to you. To the extent that any provision is unenforceable, the remainder of this EULA remains in full force and effect.
Use of the App is subject to our Privacy Policy, which is incorporated into this EULA by reference. This EULA also includes any additional payment terms shown on the purchase screen in the App. Your use of the App is also subject to the Apple Media Services Terms and Conditions.
Age Requirement
You must be 13 years of age or older to install or use the App. If you are at least 13 but under 18 years of age, or under the age of majority where you live, please have your parent or legal guardian review this EULA with you and install the App for you.
Notice to parents and guardians: by permitting your child to download and use the App, you agree to this EULA on behalf of your child and are responsible for supervising your child’s use of the App. If you are the parent or guardian of a child under 13 and believe that he or she is using the App, please contact us.
Grant of License
Subject to your compliance with this EULA, Maxima Apps grants you a non-exclusive, revocable, non-sublicensable, non-transferable license to download, install and use the most current generally available version of the App on Apple-branded devices that you own or control, solely for your lawful, personal and non-commercial use, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, including Family Sharing where we have enabled it.
Description of Other Rights and Limitations
Restricted Use. You may not rent, sell, lease, sublicense, distribute, assign, copy or otherwise transfer the App or any rights in it, or use the App for the benefit of any third party. You may not modify, reverse engineer, decompile or disassemble the App, or attempt to access or derive its source code, except to the extent expressly permitted by applicable law. You may not circumvent usage limits, subscription restrictions or security features, access our servers other than through the App, or use any robot, spider or other automated means to interfere with the proper working of the App.
Acceptable Use. You agree not to use the App to break any law or infringe the rights of others, including privacy and intellectual property rights; to create or translate content that is unlawful, harassing, hateful, sexually exploitative of minors or that promotes violence; to record or translate another person’s speech in Conversation mode without their knowledge where consent is required by law; to use the App or its output to build or train a competing artificial intelligence model or translation service; or to impersonate another person or mislead anyone about the source of a translation.
Updates. We reserve the right to add, change or remove features of the App at any time, including to comply with law or with changes made by our service providers. The App periodically communicates with our servers. Updates may be installed automatically or with prior notice, and some updates may be required in order to continue using the App.
Access. You must provide, at your own expense, the device, internet connection and service plan needed to use the App, and your network provider’s fees may apply. Not all features are available on all devices or in all locations.
Free Version and Pro Subscription
Free Version. You may use the App free of charge, subject to usage limits. The free version currently allows 5 text translations per day, up to approximately 500 characters per translation, 3 voice inputs per day, and 5 turns per conversation. Photo translation, PDF translation and offline translation are not available in the free version. We may change these limits from time to time, and the limits that currently apply are shown in the App. When you reach a daily limit, you may wait for it to reset the following day or upgrade to Pro.
Pro Subscription. Pro removes or raises the free usage limits and unlocks photo translation, PDF translation, offline translation and the other features shown on the subscription screen. Pro is offered as auto-renewable subscriptions, such as weekly, monthly or yearly plans, and, where offered, as a one-day pass. The one-day pass is a one-time, non-renewing purchase that provides Pro access for 24 hours from the time of purchase.
Subscription Information. Before you purchase, the subscription screen shows the title of each plan, the length of the subscription period, its price, and the features it includes. Prices may vary by country or region and include applicable taxes where required.
Free Trial. Where a free trial is offered, for example a 3-day free trial, the length of the trial and the price that will be charged when it ends are shown before the trial starts. Unless you cancel at least 24 hours before the end of the free trial, your subscription will automatically begin and your Apple ID account will be charged the subscription price. Any unused portion of a free trial is forfeited when you purchase a subscription.
Payment and Automatic Renewal. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically at the same price and for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
Managing and Cancelling. You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings (Settings > your Apple ID name > Subscriptions). Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. Deleting the App does not cancel your subscription.
Restoring Purchases. If you change or reinstall your device, you can restore your Pro access on any device signed in to the same Apple ID by tapping Restore Purchases in the App.
Refunds. All purchases are processed by Apple. Refunds are handled by Apple in accordance with its policies and can be requested at reportaproblem.apple.com. Maxima Apps cannot issue refunds for App Store purchases.
Price and Feature Changes. If we change the price of a subscription, Apple will notify you in advance and, where required, ask for your consent before the subscription renews at the new price. We may change the features included in Pro, but we will not remove the primary functionality you have paid for during a subscription period you have already paid for.
Translate AI App Functionality
The App provides text, voice, photo, camera, PDF and conversation translation, AI insights (Smart Suggestions), text-to-speech and offline translation. Online translations and Smart Suggestions are generated automatically by artificial intelligence provided by a third party, Google Gemini, and offline translations are generated by on-device models.
AI-generated output may be inaccurate, incomplete or culturally inappropriate. You must not rely on the App for medical, legal, financial, safety-critical or emergency communication, or for official, certified or contractual translations, and you should have important translations checked by a qualified human translator.
Some features depend on your device and operating system. Live Scanner requires a supported device. The iPhone Duo guest-facing display depends on a system capability that may not be available and may show a blank screen. Offline translation is available to Pro subscribers for downloaded languages only and may be less accurate than online translation.
The App requests access to your device’s camera, microphone, speech recognition, photo library and notifications only for the features you choose to use, as described in our Privacy Policy. Camera access is used only for features you actively start and is not used to collect information passively. PDF files are imported through your device’s system file picker, and no storage permission is requested. You may refuse or withdraw any permission in your device’s Settings; only the features that need that permission will stop working.
Third-Party Partners
Third-Party Services. The App relies on services provided by third parties, including Google (Gemini, Cloud Text-to-Speech, ML Kit and Firebase), Qonversion (subscription management), Meta (advertising measurement, only with your tracking permission) and Apple (speech recognition, VisionKit and in-app purchase). The terms and privacy policies of those third parties may apply to their services. Their availability is outside our control, and features may change or stop working if a provider changes its service. Maxima Apps is not responsible for third-party content, websites or transactions.
Access to Content. Translations are generated automatically from the content you submit, and you may be exposed to output that you find inaccurate, offensive or objectionable. You assume all risks associated with such content.
Security
We take reasonable measures to protect the App and your information, as described in our Privacy Policy. However, no software or online service is completely secure. You are responsible for securing your device, and Maxima Apps is not liable for unauthorised access to your device or to data stored on it.
Registration and Passwords
The App does not require registration, login or a password. An anonymous identifier is created automatically to provide subscription features, as described in our Privacy Policy. You are responsible for the security of the Apple ID used to make purchases.
Uninstall/Removal
To uninstall the App, use your device’s standard method for removing apps, or consult your device’s user manual. Uninstalling the App removes your history, bookmarks and saved conversations from your device but does not cancel an App Store subscription; you must cancel it in your Apple ID account settings.
Consent to Use of Data
You agree that we may collect and use technical and related information, as described in our Privacy Policy, to provide, update, support and improve the App. You acknowledge that the content you submit for online translation is processed by our third-party AI provider to provide the translation. On Apple devices, consent to tracking and to the use of your device’s advertising identifier is requested only through Apple’s App Tracking Transparency prompt. This consent is separate from and independent of your agreement to this EULA, and granting or denying it does not affect your right to use the App. You may change your choice at any time in Settings > Privacy & Security > Tracking.
Intellectual Property
All content, code, design, text, graphics and other materials in the App, and all related trademarks, are owned by Maxima Apps or its licensors and are protected by intellectual property laws. This EULA does not grant you any right to use our trademarks or copyrighted material without our permission. Third-party names, marks and language data remain the property of their respective owners.
Copyright and Submissions
Your content. You retain all rights in the text, voice, images and documents you submit to the App (“Input”) and in the translations returned to you (“Output”). You grant Maxima Apps and its service providers a limited license to process your Input solely as necessary to provide the App, as described in our Privacy Policy. We do not claim ownership of your Input or Output.
Your responsibility. You are solely responsible for your Input and represent that you have the right to submit it, including any personal information about other people and any copyrighted material.
Feedback. If you send us suggestions or feedback about the App, we may use them without any obligation to you.
Infringement. Maxima Apps respects intellectual property rights. If you believe that the App infringes your rights, please contact us at the address below.
Termination
Your rights under this EULA terminate automatically if you materially fail to comply with it. Maxima Apps may suspend or terminate your access to the App at any time for such a breach. You may stop using the App at any time by uninstalling it. The provisions of this EULA that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability and indemnification, will survive.
Disclaimer of Warranty
To the fullest extent permitted by applicable law, the App and all translations are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Maxima Apps does not warrant that the App will be uninterrupted, secure or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by applicable law, Maxima Apps is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on a translation. Our total liability for all claims relating to the App is limited to the amount you paid for the App and subscriptions in the 12 months before the claim arose. Nothing in this EULA limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Maxima Apps from any third-party claims arising from your use of the App, your Input, your violation of this EULA, or your infringement of the rights of any third party.
Apple App Store Terms
The following terms apply because you obtained the App from Apple’s App Store.
Acknowledgement. This EULA is concluded between you and Maxima Apps only, and not with Apple Inc. (“Apple”). Maxima Apps, not Apple, is solely responsible for the App and its content.
Scope of License. The license granted to you is limited to use of the App on Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.
Maintenance and Support. Maxima Apps is solely responsible for providing maintenance and support for the App, as specified in this EULA or as required by applicable law. Apple has no obligation whatsoever to provide any maintenance or support services for the App.
Warranty. Maxima Apps is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
Product Claims. Maxima Apps, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, Maxima Apps, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal Compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Developer Name and Contact. Any questions, complaints or claims with respect to the App should be directed to Maxima Apps at feedback@maximaapps.com.
Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement, such as your wireless data service agreement, when using the App.
Third-Party Beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of this EULA, Apple will have the right, and will be deemed to have accepted the right, to enforce this EULA against you as a third-party beneficiary.
Export Controls
The App is subject to United States and other applicable export control and sanctions laws. You may not use, export or re-export the App in violation of those laws.
Jurisdiction and Miscellaneous Terms
Maxima Apps may limit the availability of the App in certain jurisdictions. This EULA is governed by the laws of the jurisdiction in which Maxima Apps is established, without regard to conflict-of-law principles. If you are a consumer, you retain the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts. Before starting any claim, please contact us so that we can try to resolve the matter informally within 30 days. To the extent permitted by law, any claim must be brought within three years of the event giving rise to it.
If any provision of this EULA is held to be unlawful or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer this EULA; we may assign it as part of a merger, acquisition or sale of assets. This EULA and our Privacy Policy constitute the entire agreement between you and Maxima Apps regarding the App. If this EULA conflicts with the Apple Media Services Terms and Conditions, the Apple terms prevail to the extent of the conflict.
